1 INTRODUCTION

2 CHANGES TO THESE TERMS AND CONDITIONS 2.1 NetPlay TV reserves the right to amend these terms and conditions. However, the Company will ensure that the Player is notified of such amendment and that their consent to the amendment is requested the first time that they access their Account subsequent to any amendment. If the Player does not agree to the amendment of these terms and conditions, they will not be permitted to play the games. 2.2 It remains the Player’s responsibility to periodically check the terms and conditions to ensure that they continue to agree with them and Players are advised to check these terms and conditions each time they wish to place a bet in relation to any of the games. Any bet received (but not settled) prior to the time of amendment and notification of amended terms and conditions will be subject to the pre-existing terms and conditions. 2.3 We can change the selection of Games on offer, and/or their rules, however notice of any changeswill be given in accordance with the procedure set out above. We will not change any Game in which you have already placed a bet. 3 REGISTRATION AND ACCOUNT USE 3.1 To play a Player must register and open an account (an "Account") using a credit or debit card, with a minimum deposit of £10. Registration is only available to persons aged 18 or over and is subject always to the previous and on-going compliance with these terms and conditions. Registered Players may wager up to the limit available in their Account. 3.2 The Player agrees to provide accurate information to NetPlay TV on registration and it is the Player's responsibility to ensure that their personal details are kept up-to-date on the Website especially address, telephone number and payment/bank details. The Player authorises NetPlay TV to use any lawful means that it considers necessary to verify the information provided by the Player on registration. 3.3 The Account will be used by the Player only. NetPlay TV reserves the right to decline account opening for any reason. The Account is intended for administering the Player's funds, play and fees, as well as bets, refunds, winning payments, cash-outs and any applicable service fees. 3.4 A Player may open only one Account. Any additional accounts that are funded may be closed and the deposit amount returned to the Player or all such accounts may be treated as one joint Account, in either case at NetPlay TV’s discretion. 3.5 The Player must select a username and password on registration. It is the Player's responsibility to ensure that they keep such details confidential and the Player shall be fully responsible for any misuse of their password. In the event that a Player is concerned that their password has been disclosed to a third party, they should notify NetPlay TV immediately whereupon a new password may be given. Unless caused by NetPlay TV’s negligence, any unauthorised use of the username and password shall be the Player’s sole responsibility and be deemed as their use. 3.6 NetPlay TV may require the Player to change their password or NetPlay TV may suspend the Player’s Account if NetPlay TV has reason to believe that there is likely to be a breach of its security policies or misuse of the Games or the NetPlay TV SuperDraw website. 3.7 To maintain a high level of security to protect Player funds, NetPlay TV may perform random security checks. The Player hereby accepts that NetPlay TV retains the right to demand additional documentation from them in order to verify the Player as the Account holder or cardholder in the event of such a security check. In particular, as part of our standard procedure we may ask players, who have deposited more that £1000, for photographic identification and proof of residence. 3.8 The Player will inform NetPlay TV as soon as reasonably possible if they believe that their Account information is being misused in any way by a third party so that NetPlay TV may suspend their Account. NetPlay TV will not be held responsible for any reasonable delay in such suspension. The Player will not allow any other person or third party (including, without limitation, any minor) to use their Account or accept any prize on their behalf. 3.9 NetPlay TV reserves the right, upon providing notice to the Client, to close the Player's Account and refund the balance of the Player’s Account at NetPlay TV’s reasonable discretion without further explanation. 3.10 The Player may withdraw money from their Account at any time provided that their balance has been confirmed. 3.11 The Player may cancel their Account at any time by informing NetPlay TV in writing at NetPlay TV, Netplay TV Services Ltd, P.O.Box 58140, London, SW8 3UU, or by email by contacting support@bigboxbingo.com. If the Player does so, they will not be permitted to participate in any of the Games. 3.12 If an Account is inactive for 12 months or longer, NetPlay TV reserves the right to close these Players accounts. Any funds held in a closed account will be transferred to a holding account, minus an administration fee of £10, or the total wallet balance should the balance be less than £10. Should a Player wish to withdraw these funds after the closure of the account they must apply in writing to NetPlay TV’s Customer Services. 3.13 NetPlay TV or the Player may suspend or cancel the Player’s Account immediately if the other breaches any of its obligations under these terms and conditions. Return of any outstanding balance to the Player will be subject to the provisions of these terms and conditions. The suspension or cancellation of the Player's Account shall not affect either party's statutory rights or liabilities. 3.14 Employees of NetPlay TV and any associated company are not eligible to participate in the Games. 4 AVAILABILITY OF THE GAMES 4.1 The odds and payout rates for each Game can be found in the game rules.(19) 4.2 To place a bet the Player must have sufficient credit in the Player’s account. If you do not have sufficient credit to cover all your bets then your bets will not be placed at all. 4.3 Your bet may not exceed the bet limit in force in relation to each game. Each game has different bet limits - for those limits see the individual game rules(19). 5 PLAYER REPRESENTATIONS 5.1 The Player is over the age of 18 and has the mental capacity to take responsibility for their own actions. NetPlay TV reserves the right to void any transactions involving minors. The Player confirms that he/she is aware that underage gambling is a criminal offence. 5.2 The Player understands that by participating in the Games they may lose money on bets placed and they accept full responsibility for such loss. The Player also agrees that their use of the NetPlay TV Superdraw website is at their sole risk. 5.3 The Player understands that NetPlay TV may, from time to time ask the Player to participate in marketing and promotion for NetPlay TV by the use of the Player’s name and likeness. The Player may consent or refuse such requests at the Player’s discretion. 5.4 The Player warrants that they will not attempt to hack, make unauthorised alterations to or introduce any kind of malicious code to the NetPlay TV Superdraw website. As such, the Player will not, without limitation, (a) reverse engineer or decompile (in whole or in part) any software available through the Website; or (b) make copies, modify, reproduce, transmit, alter or distribute all or any part of the Website or any material or information contained on it. 5.5 The Player acknowledges that NetPlay TV (or our licensors) are the sole owner of all rights to technology, software, business systems and content utilised in the NetPlay TV Superdraw website and the Player’s use of the website (and registration thereon) confers no rights whatsoever to intellectual property contained or utilised therein. Copying, use or publication by the Player of any item or material displayed on the website is strictly prohibited (other than to the extent necessary for you to visit the website and place bets, including keeping records of bets placed and of the Player’s Account). The Player is offered access to the NetPlay TV Superdraw website solely for the Player’s own personal, non-commercial use. The Player must not link the NetPlay TV website to any other website without NetPlay TV’s prior written approval. 5.6 The Player agrees that BigBoxBingo may lock or terminate a Player’s Account if: • a Player breaches these terms and conditions; • a Player's funds are insufficient for the continued participation in the Games; • NetPlay TV has reason to believe that the Player’s dealings with NetPlay TV constitutes an illegal or fraudulent activity, NetPlay TV shall not (to the extent permitted by law) be liable to that Player for any such deposits, nor shall it incur any liability to any Player where it is required to give information or documentation relating to that Player to any relevant regulatory authority; • NetPlay TV suspects that access to the Account may not be by an authorised person; • legal or regulatory requirements require such locking or termination; or • a security, disrepute or other issue deemed reasonably significant by NetPlay TV arises. 5.7 The Player accepts that NetPlay TV reserves the right to void any bets in the event of errors or technical problems caused to the NetPlay TV Superdraw system. If a player is able to prove satisfactorily that NetPlay TV has voided a bet that would otherwise have been successful, NetPlay TV agrees to discuss suitable compensation for the player subject to and in accordance with the provisions of clause 17 below.
5.8 These terms and conditions contain the entire agreement between the Player and NetPlay TV relating to the Games. The Player confirms that, in agreeing to accept these terms and conditions, they have not relied on any representation save insofar as the same has expressly been made a representation in these terms and conditions. The Player agrees that they shall have no remedy in respect of any misrepresentation which has not become a term of these terms and conditions save that their agreement shall not apply in respect of any fraudulent or negligent misrepresentation whether or not such term has become a term of these terms and conditions. 6 PAYMENT AND SECURITY 6.1 Money in a Player’s Account is used to place bets and therefore to participate in the Games. NetPlay TV reserves the right to refuse or limit any wager. Players are not allowed to place a wager greater than the amount deposited in their Account. Any winnings will either be placed into the Player’s Account or paid by cheque as more particulary set out in the game rules. 6.2 The maximum single deposit is £3,000. Credit card deposits are limited to a maximum of £10,000 in any calendar month. There is no limit on deposits made by debit card, bank transfers, cheques or postal orders. 6.3 You can top up your account by visting the “Money Moves” area of the website and following the online prompts. Please note that the card must be in the name of the registered player. 6.4 All bets stand and no bet can be cancelled once confirmed by NetPlay TV. 6.5 A player may suspend their Account at any time. A suspended Account means that funds can temporarily not be used for gaming. The decision to suspend an Account is taken by the player. 6.6 Upon request by the player, NetPlay TV will action a payment by cheque or to the player's bank account of part or whole of the player's funds at the time of the transfer request, with deductions for eventual service fees, bank fees etc.
7 WALLET 7.1 Your Account will have an associated Wallet managed by the NetPlay TV system. You deposit funds into your Wallet in order to play the game. 7.2 If you opt to open a Wallet, you will nominate the amount to be taken from your credit or debit card account. The minimum deposit is £10. You can top up your Wallet at any time but you will also be able to set your own limit on the amount that goes into your Wallet, as part of NetPlay TV’s responsible play policy. 7.3 NetPlay TV will verify that the credit is available to cover the deposit you specify and that the card has not been reported lost or stolen and will load the Wallet accordingly. 7.4 When you wish to participate in a Game and place a bet, NetPlay TV will check that there are sufficient funds in the Wallet. If not, you will need to top up the Wallet with a further payment first. 7.5 You will be able to remove funds from your Wallet at any time (provided that we have not become entitled to suspend it) by nominating a bank account or building society account ("bank account") into which you wish to transfer funds. The bank or building society must be in the UK. You will be asked for the bank account details and a Bank Account Withdrawal Key (sent to you as part of your welcome pack) on the first occasion on which you wish to take funds from your Wallet. You will only be asked for this information once and your account details be added to your personal details for future funds transfer. The minimum withdrawal amount is £5 unless you are closing your Account completely, which must be done by contacting customer services directly. 7.6 All withdrawals over £500 will be paid out by cheque. 7.7 If a Subscription Player wishes to transfer funds from a Wallet, they should use the online wallet facility or contact BigBoxBingo Customer Services. Customer Services will request bank or building society account details into which funds should be transferred or otherwise ask for confirmation of authorisation to transfer funds to an existing bank account. 7.8 You will not be entitled to interest on funds that are held in your Wallet. 8 The 105 Club 8.1 NetPlay TV may contact players to participate in the 105 Club promotion offer giving 100 free entries in the 10m Euro bonus Ball draw. 8.2 To qualify for entry to the promotion players must complete a £5 subscription to Superdraw. Entry to the 105 Club promotion will happen automatically each week while the player’s subscription is active. Where a subscription lapses the player’s entry into the promotion will also lapse. 8.3 The prize of 10,000,000 Euros will be split evenly between the total amount of 105 Club players. The total amount of participants will vary depending on how many players subscribe in any given week. 8.4 In order to win all six numbers plus the bonus ball must match those drawn. No prizes are awarded for matching 2, 3, 4, 5 or 6 numbers. 8.5 Prize winners will be notified in the usual way and all participants are guaranteed their full share of the prize money according to the number of 105 Club syndicate entries they hold. 8.6 In the event of any failure to complete your entry, whether for reason of force majeure, processing delays, human or technical error by NetPlay TV, its employees or agents, NetPlay TV is liable only for the amount of money paid for the order. 8.7 In the event of a discrepancy between the numbers submitted on your entry and the numbers appearing on your confirmation, confirmed numbers are considered final. 9 CHARGEBACKS 9.1 If you notify your card supplier of unauthorised use of your card or there is any other circumstance leading to a ‘chargeback’ and NetPlay TV is asked to refund the amount, NetPlay TV will suspend your Account and ask you to contact NetPlay TV Customer Services. NetPlay TV reserves the right to debit your Wallet with the chargeback or to recover the amount from you if there are insufficient funds in your Wallet. You agree to pay this sum promptly if properly required by us. You will not be allowed to participate in further Games until the chargeback has been successfully resolved. 10 NO WARRANTY 10.1 NetPlay TV will endeavour to provide the Games using its reasonable skill and care. Save where required by law, NetPlay TV makes no warranty or representation, whether express or implied, in relation to the Games. 10.2 NetPlay TV makes no warranty that the Games will meet the Player’s requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Games or the server that makes it available are free of viruses or bugs, nor does NetPlay TV make any warranty as to the full functionality, accuracy, reliability of the materials supplied by NetPlay TV or results of Games or the accuracy of any information obtained by the Player through the Games. 10.3 The Player’s access to the Games may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. In this event, NetPlay TV will attempt to restore the service as soon as it reasonably can. 11 NetPlay TV CONDUCT AND LIMITATION OF LIABILITY 11.1 The Player agrees that their participation in the Games is at their sole risk. 11.2 NetPlay TV reserves the right to withdraw the Games or elements of the Games at any time, and will not be liable to the Player as a result of any such action. 11.3 NetPlay TV will not be held responsible for any typing, technical, or human error in the operation of the Games. In the event of error, NetPlay TV reserves the right to either void any affected bets or to correct the error. 11.4 NetPlay TV will under no circumstances be held liable for any damages or losses of an indirect nature that are deemed or alleged to have resulted from or been caused by the Games, the NetPlay TV Superdraw website or its content including, without limitation, delays or interruptions in operation or transmission, communication line failure, any persons use or misuse of the NetPlay TV Superdraw website or its content, any errors or omissions in content, damage for loss of business, loss of profits, business interruption, loss of business information, or any other pecuniary or consequential loss. 11.5 NetPlay TV will not be responsible for any breach of these terms and conditions caused by circumstances beyond its reasonable control. 11.6 NetPlay TV’s liability under 12.4 above shall be limited to the commission received by NetPlay TV in respect of the bet or bets which are the subject of any breach by NetPlay TV. 11.7 NetPlay TV does not exclude or limit liability for death or personal injury caused by negligence or for fraud. 11.8 NetPlay TV reserves the right to withdraw the NetPlay TV website, the Games or elements of either at any time, and save for any rights that the Player may have over deposited funds in its Account, will not be liable to the Player as a result of any such action. 12 SOCIALLY RESPONSIBLE GAMBLING 12.1 A Player may at any time apply to exclude themselves from participating in the Games. If a Player wishes to limit their gambling activities at any time, he/she should visit www.superdrawtv.com or contact support@bigboxbingo.com. 13 FRAUDULENT AND ILLEGAL USE OF THE WEBSITE OR THE GAMES 13.1 If NetPlay TV has reason to believe that the Player’s dealings with NetPlay TV constitutes an illegal or fraudulent activity and to the extent permitted by law, NetPlay TV shall not be liable to that Player for any such deposits, nor shall it incur any liability to any Player where it is required to give information or documentation relating to that Player to any relevant regulatory authority. 14 TRANSFER 14.1 The Player may not transfer any of their rights under these terms and conditions to any other person. NetPlay TV may transfer its rights under these terms and conditions to another business where its reasonably believes that its rights will not be affected. 15 THIRD PARTY RIGHTS 15.1 Except insofar as these terms and conditions expressly provide that a third party may in their own right enforce a term of these terms and conditions, a person who is not a party to these terms and conditions has no right under local law or statute to rely upon or enforce any term of this agreement. 16 SETTLEMENT OF DISPUTES 16.1 If the Player has any dispute with regard to any outcome in the Games or any other activity, the Player should submit their complaint to NetPlay TV in writing within fourteen (14) days of the incident by email to complaints@bigboxbingo.com or in writing to NetPlay TV, Netplay TV Services Ltd, P.O.Box 58140, London, SW8 3UU. If the parties cannot agree a resolution to any dispute with twenty one (21) days of the receipt of the complaint by NetPlay TV, the dispute will be referred to an independent dispute resolution body such as IBAS. 17 NOTICES 17.1 The Player may submit notices to NetPlay TV in writing at: Netplay TV Services Limited, P.O.Box 58140, London, SW8 3UU. Any notice NetPlay TV gives to the Player (save as otherwise set out herein) will be sent to the email address that the Player provided when the Player registered their Account. 18 GENERAL 18.1 If any part of these terms and conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these terms and conditions and shall not affect the validity and enforceability of any of the remaining provisions of these terms and conditions. 18.2 No waiver by NetPlay TV of any of these terms and conditions shall be construed as a waiver of any preceding or succeeding breach of any of these terms and conditions. 18.3 Nothing in these terms and conditions shall be construed as creating any agency, partnership or any other form of joint enterprise between the Player and NetPlay TV. 18.4 The Player confirms that they have read, understood and accept the NetPlay TV privacy policy. 18.5 The Games are subject to the laws of England and any dispute arising out of or relating to the Games shall be governed by the laws of England. The SuperDraw is a numbers betting Game in which Players bet on selections of numbers in one or more games. THE GAMES Superdraw Game For the Superdraw game a user bets on a group of 6 numbers from a field of 1 to 49. No two bets may feature the same group of numbers. Should your bet include a group of numbers that has already been taken you will be informed and asked to amend your bet.
NetPlay TV Services Ltd Determination of Winners The generation of the numbers to determine the results of the bets made in each game will take place once each week. Game Closure The rules of each Game will include a regular time for the Closure of the Game after which time no further bets will be accepted for the Game. You will also be given regular warnings through the website of the time for closure of a Game. NetPlay TV’s database will refuse all bets submitted after the specified game closure time and will ensure that no further bets are made after the Closure . If your entry is not received by us before Closure, even if you sent it, it will be deemed void. You accept that the risks of bets being lost or delayed in transmission lies with you (whether electronic or postal transmission and including delays in transmission or processing of entries you make while visiting our website).
